school was in a very flourishing condition during the official year 1883-84. The whole of the expenditure was met from fees, subscriptions and Rs. 78 grants. Nothing was shown as drawn out of the endowment fund (viz, Rs. 475 deposited in the Savings Bank which the Committee had handed over to: the complainant). As a matter of fact, however, the Savings. Bank book shows that on the 21st March 1884 the complainant drew out of the Bank Rs. 3oo, on the 2nd April 1884 he drew out Rs. 170 and on the 26th May 1884 he drew out Rs. 8. The fact that the sum of Rs. 3oo drawn in March 1884 is not shown in the financial statement Ex. LXXII is. almost conclusive proof that it was not drawn for expenditure on the school, and if not drawn for that purpose the inference is almost irresistable that it was drawn for the complainant's private purposes and was therefore misappropriated. This inference is corroborated by the complainant's subsequent conduct in October 1884 when he handed back the management of the school to the committee, in debt and with the accumulated surplus he had received in August 1883 all spent (except about Rs. 18 in the Savings Bank). He at first distinctly promised to render accounts (Ex. LX). Subsequently the new Manager Mr. Vanstavern (the 20th Def. Witness) found he could get no accounts out of him and no replies to his letters asking for accounts. After sometime one of the masters sued complainant for arrears of pay due to him and an arbitrator was appointed to enquire into the matter. To that arbitrator the complainant rendered a partial account Ex. LXXXVI of the money he had drawn from the Savings Bank in which occur the following items.
